Labour & Employment Law Group provides innovative and practical
advice to help employers address discipline and compensation issues,
downsizing, the interpretation of collective bargaining agreements
and dealing with work stoppages. We also help to ensure smooth
collective agreement negotiations and avoid damaging arbitration
decisions.
Our practice in this area encompasses three related disciplines:
Labour Law - which involves organizations with unions; Employment
Law - involving organizations without unions; and Administrative
Law - involving the interaction of both types of organizations
with regulatory bodies or tribunals.
On Labour & Employment Law matters our lawyers have appeared
before a wide range of regulatory agencies, disciplinary tribunals
and arbitration boards, as well as Canadian courts at all levels,
up to and including the Supreme Court of Canada.
MLT's experience in Labour Law extends back to the very origin
of trade union legislation in Western Canada. Over the years we
have developed comprehensive experience before Labour Relations
Boards, addressing issues such as applications for union certification,
unfair labour practices and de-certifications. Where collective
agreements are concerned, we are available to assist in planning
your negotiating strategies, to advise you on the dynamics of
bargaining, and to conduct your negotiations.
In the sphere of Employment Law, we can provide sound practical
and legal advice on a full spectrum of issues, from basic questions
about safety, overtime and statutory holidays to more complex
issues such as substance abuse and personal searches. We have
represented clients before various Human Rights Commissions in
Western Canada, and we counsel on ways to prevent human rights
difficulties from ever arising in the first place.
Our Labour & Employment Law Group can provide advice on all of
these issues, as well as the tax implications of pension, disability
and other group benefits plans and, should it become necessary,
our lawyers can also provide effective representation in the litigation
of claims involving such plans.
