Joanne Klauer’s municipal law practice is extensive and diverse. It includes general counsel work, planning and development law, leave to appeal applications, drafting and reviewing contracts and by-laws, judicial review applications, annexations, inter-municipal disputes, expropriations, employment law, by-law enforcement, Freedom of Information and Protection of Privacy Act issues, and environmental law. Joanne drafts and reviews contracts, policies and bylaws; advises administration, Councils and Council committees, Subdivision and Development Appeal Boards; and represents municipalities before the Alberta Court of Appeal, Alberta Court of Queen’s Bench, Municipal Government Board, Environmental Appeal Board and other tribunals.

Representative Work

  • General Counsel for a number of urban and rural municipalities in southern Alberta since 1995.
  • City of Airdire/Rocky View County, MGB 2011, annexation application.
  • Town of Okotoks v. MD of Foothills No. 31, MGB 2011, inter-municipal dispute.
  • MacKenas Estates v. Rocky View County and City of Calgary, 2011 ABQB, successfully defended an application compelling the municipalities to connect private lands to municipal utility service.
  • Keller v. Municipal District of Bighorn No.8, 2010 ABQB 362, successfully defended an application to have municipal bylaws creating Transfer of Density Credit program declared invalid.
  • Benign Energy v. MD of Pincher Creek, ABCA, successfully defended leave to appeal application.
  • Craig v. Bighorn (Municipal District No.8), 2009 ABCA 119, successfully overturned the decision of the Alberta Court of Queen’s Bench directing Council to amend its Land Use Bylaw and issue a Development Permit.
  • City of Calgary / Rocky View County, MGB, successfully dismissed inter-municipal appeal on preliminary jurisdictional issue.
  • Town of Chestermere / Rocky View County, MGB 018/09, annexation application.
  • Westridge Utilities v. Rocky View County, EAB, successfully dismissed appeal.
  • City of Calgary / Rocky View County, MGB 079/07, annexation application.
