The intellectual property holdings of MLT's clients span numerous technological areas – from polymer chemistry-based inventions to children’s television programs. We are heavily involved in IP registration and enforcement for companies in the agriculture and oil and gas sectors. Our oil and gas experience is focused on downhole tools and software and drilling control systems, as well as downstream processing techniques. Computer software and business method inventions – including hardware, database schema, design and use, and assembler and compiler code inventions, as well as more general e-commerce and other computer implemented business methods – are another particular competency for MLT.
We routinely handle applications for foreign and domestic patent, trade-mark, copyright and other intellectual property registration matters, as well as franchising, licensing, clearance and due diligence, opinions and defence and enforcement work pertaining to all manner of intellectual property rights. Our strong intellectual property litigation team has appeared before all relevant tribunals and all levels of Canadian courts, including the Federal Court of Canada and the Supreme Court of Canada. One case of note handled by lawyers of the firm, which resulted in a complete overhaul of the Canadian patent maintenance system, is Dutch Industries v. Barton No-Till Disk and the Commissioner of Patents. MLT's litigation team was also successful in the first action ever brought under Canada’s Plant Breeders’ Rights Act.
